Legal hosting model before furnished-property assumptions

New York City’s Office of Special Enforcement explains its short-term rental registration framework and exemptions. Verify the lawful hosting model and building status before evaluating a purchase as an STR investment; registration is not a blanket authorization for every furnished apartment. Define the property study

Define whether the taxpayer owns the building, a condominium interest, or only furnishings in leased space. A tenant furnishing a room cannot simply commission a study of the landlord’s building basis. For an owned unit with personal use, document the actual guest space and shared areas. Discuss any cooperative interest or unusual ownership form directly with the preparer before assuming a conventional building study fits.

Records that resolve the main questions

A scoping example

A host leases an apartment and buys furniture. The apartment’s market value is not the host’s building basis. The preparer should evaluate the host-owned assets and any tenant improvements within the actual ownership and lease terms instead of using a whole-apartment purchase model.

Illustrative documentation scenario; not a completed client study or a savings estimate.

Does furnishing an apartment create building basis for the host?

No. The underlying ownership and spending facts must support what is analyzed. Identify assets the host actually owns and review the lease before requesting a building-level cost segregation proposal.
